These Terms and Conditions govern your use of the Aus Agro Australia website and the purchase of products and services from AUS AGRO PTY LTD (we, us or our). By using our website or placing an order, you agree to these terms.

1. Definitions

  • Website means https://www.ausagro.com.au and any related pages.
  • Products means agricultural machinery, spare parts, accessories and related goods sold by us.
  • You means the person or entity browsing the website or purchasing products.

2. Use of the website

You agree to use our website lawfully and not to interfere with its operation or security. We reserve the right to suspend access, remove content or refuse service at our discretion.

3. Quotes and orders

Quotes provided through our website or by our sales team are valid for the period stated or, if no period is stated, for 14 days. Orders are accepted only when we confirm them in writing or process payment. We reserve the right to cancel or refuse any order due to pricing errors, stock availability or suspected fraud.

4. Pricing and payment

All prices are in Australian Dollars (AUD) unless otherwise stated and include GST where applicable. Freight, delivery and installation costs are quoted separately unless expressly included. Payment terms are set out in your invoice or quote.

5. Freight and delivery

Delivery times are estimates only and depend on stock availability, your location and carrier schedules. Risk in the products passes to you on delivery or on arrival at the nominated freight depot, whichever is earlier. For large machinery, depot pickup may be required unless delivery has been expressly arranged. Goods left uncollected at a depot for more than 10 business days may incur storage, re-delivery or return-to-sender charges payable by you. Once a machine has been crated or dispatched, an order may not be cancelled.

6. Returns, refunds and warranty

We do not accept change-of-mind returns on machinery. Unused spare parts and accessories may be returned within 14 days of delivery, in original resalable packaging, with a return authorisation number, at your cost for return freight and subject to a 15% restocking fee. Used, fitted, custom, special-order and opened consumable items are not returnable. Our 12-month manufacturer warranty applies to eligible machinery used and maintained in accordance with manufacturer instructions. Nothing in these terms limits your rights under the Australian Consumer Law for faulty, damaged or mis-described goods. 7. Limitation of liability

To the extent permitted by Australian consumer law, our liability for any loss or damage arising from the supply of products or use of the website is limited to the purchase price of the relevant product or service. We are not liable for indirect, consequential or economic loss.

8. Intellectual property

All content on this website, including text, images, logos, videos and product descriptions, is owned by or licensed to us. You may not reproduce, modify or distribute it without our prior written consent.

9. Privacy

Your use of the website is also governed by our Privacy Policy.

10. Governing law

These terms are governed by the laws of Queensland, Australia. Any dispute arising from these terms or your use of the website will be subject to the exclusive jurisdiction of the courts of Queensland.
